Supreme Court Begins Review of the Affordable Care Act

Today, the Supreme Court began its historic review of the constitutionality of the Affordable Care Act. As you are likely aware, several of the Affordable Care Act’s provisions have come under intense scrutiny, and after several conflicting appellate court rulings, the Supreme Court took up oral arguments on the constitutionality of the Affordable Care Act this morning, lasting through March 29th. A ruling is expected at the end of the term in late June.

As a reminder, this week the Court will consider the following:

  • The Anti-Injunction Act (which bars which bars federal courts from striking down tax provisions until they have taken effect);
  • Constitutionality of the requirement that virtually every American obtain health insurance by 2014;
  • "Severability" of the mandate from other parts of the law (whether some or all of the overall law must fail if the mandate is struck down);and
  • The constitutionality of the expansion of the Medicaid program.
